Terms of Use

These terms are the contract between you and FILIPE O. TESSARO TREINAMENTO PROFISSIONAL LTDA, CNPJ 37.779.269/0001-28, based in Marau/RS, Brazil, trading as Tessaro Apps, for the use of the GarageRank.

By creating an account and using the app, you agree to what is written here. If you do not agree, do not use the app.

GarageRank is not intended for children under 13. Between 13 and 18, use depends on the consent and supervision of a parent or legal guardian — including for any purchase inside the app.

The app has community features: public profiles, photos, direct messages and clubs. Anyone using it should be aware that they are interacting with other real people.

The account is created with email and password, and the email must be confirmed before first access. Use an address that belongs to you and keep the password secret: everything that happens in your account is treated as done by you.

One person, one account. Creating multiple accounts to inflate leaderboards, likes or score is grounds for suspension.

You can delete your account at any time — the steps are on the account deletion page.

GarageRank is a cataloguing and community app for collectors of diecast model cars. It lets you record your collection, publish photos, follow other collectors, join clubs, keep a wishlist, track leaderboards and talk about trades.

The app is an organisation and community tool. It is not an auction house, a shop, a broker or a professional appraisal service, and nothing in it constitutes investment advice on collectibles.

The photos, texts and collection information you publish remain yours. You grant us only the licence needed to store and display that content inside the app — on your profile, in the feed, in the leaderboards and in the clubs you belong to.

By publishing, you declare that the photo is yours or that you have the right to use it, and that the content does not infringe anyone else's rights.

It is forbidden to publish: illegal, sexual, violent, hateful or discriminatory content; another person's personal data; someone else's image without authorisation; spam, unsolicited advertising or scams; and any material you do not have the right to distribute.

We may remove content that violates these terms and suspend repeat offenders.

There is zero tolerance for abusive content and harassment. The app offers two direct controls:

• Report a photo or a user, stating the reason.
• Block a user, which prevents contact and hides their content from you.

We review reports and act within 24 hours, removing the content, the user responsible, or both. Whoever reports is not identified to the reported user.

Read this section before agreeing to any trade.

GarageRank brings collectors together, but takes no part in the trades. We do not process payment, do not hold funds in escrow, do not verify authenticity or condition, do not handle shipping and are not a party to the agreement. The negotiation happens between you and the other person, at your own risk.

In practice: if the piece never arrives, arrives different from what was agreed, or the deal goes sour, we have no way to reverse it — there is no transaction of ours to charge back. Arrange carefully, prefer people with a history in the app, be wary of pressure to hurry, and do not send money in advance to a stranger.

Fraud or bad faith in a trade arranged through the app: report it in the app or write to us. We may suspend the account involved, but that is a disciplinary measure, not compensation.

The app uses artificial intelligence (Claude models, by Anthropic) to try to identify models from a photo, including shelf photos with several pieces.

The result is an estimate and it can be wrong: model, series, year and variation. It is not a certificate of authenticity, it is not a market valuation and it is not evidence in a negotiation. Always check the packaging, the base of the piece and reference sources before buying, selling or trading based on what the app suggested.

The free plan has two limits: up to 100 cars catalogued and up to 20 AI identifications per month. Premium removes both.

• Billing is handled by the store (Google Play or App Store), not by us. Price, duration and any trial period appear on the subscription screen before purchase.
• The subscription renews automatically until you cancel. Cancellation is done in your account settings at the store, at least 24 hours before the end of the current period.
• Refunds follow the store's policy and applicable law, including the 7-day right of withdrawal under article 49 of the Brazilian Consumer Protection Code. We do not process refunds directly.
• Deleting the account does not cancel the subscription: cancellation is always done at the store.
• We may change prices. A change never applies to a period already paid for, and you are notified before renewal.

You agree not to: circumvent the free plan limits or the subscription controls; extract the catalogue or other users' content in bulk (scraping, automation, bots); manipulate leaderboards, score or likes; use the app for illegal purposes; or interfere with the security or operation of the service.

GarageRank has no affiliation with, sponsorship from or approval by Mattel, Hot Wheels, Tomy, Maisto or any other model manufacturer. Brand, model and series names appear in the app only to identify the pieces users collect, and belong to their respective owners.

GarageRank's own code, design and trademarks are ours. You receive a personal, limited, revocable and non-transferable licence to use the app.

You may stop using it whenever you want and delete your account. We may suspend or terminate access for anyone who violates these terms — especially sections §5, §6, §7 and §10 — with notice where possible and without notice where there is risk to other users.

We do our best to keep the app running, but it may be unavailable due to maintenance, third-party failure or reasons outside our control. We may change, suspend or discontinue features. If we shut the service down entirely, we give reasonable notice and refund the paid but unused period on a pro-rata basis.

The app is provided "as is". To the fullest extent permitted by Brazilian law, we are not liable for indirect damages or lost profits arising from use or inability to use, for content published by other users, or for trade agreements made between users (§7).

Nothing here limits rights granted to you by the Consumer Protection Code that cannot be waived by contract, including liability for defects in the service.

How your data is handled is described in the Privacy Policy, which forms part of these terms.

We may update these terms. Material changes are announced inside the app before they take effect. Continuing to use it afterwards means you accept the new version.

These terms are governed by Brazilian law. Jurisdiction is that of the consumer's domicile for resolving disputes, as provided by the Consumer Protection Code.
